These terms are between Face Plan Ltd (company number 17469510, registered in England and Wales), which operates FacePlan, and the clinics and practitioners who subscribe ("you"). Patients who open a plan use it on their clinic's behalf. The person who accepts these terms for a clinic does so on behalf of every practitioner who uses the clinic's account, and is responsible for their use of it.

Subscription

A subscription is per practitioner seat, billed monthly in advance through Stripe. We may offer new clinics a free trial. When we do, the sign-up page shows its length, it needs a card on file, and nothing is charged until it ends. The trial your clinic signs up with does not change, although offers for later sign-ups may. Without a trial, billing starts when you subscribe. You can cancel at any time from the Billing page; access continues to the end of the period you have paid for. Fees are shown exclusive of VAT. Where VAT applies, it is added at the current rate and shown before you pay. There is no minimum term, and we take no commission on sales you make outside the service. If we introduce optional features that carry a fee, such as taking card payments inside a plan, they will be optional and the fee shown before you turn them on.

Founding clinics. Clinics we invite to join as founding clinics pay the founding price per practitioner seat for as long as their subscription stays continuously active, including through any change to our standard prices. This covers every seat on the clinic's subscription. Premium features we release as paid add-ons are included at no charge; transaction fees on payments and pass-through costs such as SMS are not. A missed payment does not end founding status if it is paid within 30 days of the account being suspended.

Failed payments. If a payment fails we retry it for 14 days and access continues. After that the account is suspended until payment is made. Your data is kept for the 30-day export period described below, counted from the date of suspension.

Clinical responsibility and AI

Data protection

You are the data controller for your patients' information and must have a lawful basis to record it, including for health information. We act as your processor. These terms include our data processing agreement: we process patient information, including progress photos, only on your instructions and to provide the service; we never use it for AI training or marketing, and the only analysis we perform on it is the anonymised, aggregated statistics described below; we record who views, adds or deletes a patient photo; our staff are bound by confidentiality; we keep it secure (see the Privacy page); we use only the sub-processors listed there and tell you before changing them; we help you answer patients' requests and report any personal data breach to you without undue delay; and we delete or return the data when the service ends, as set out above.

Aggregated statistics. You permit us to derive anonymised, aggregated statistics from plans and patient responses, combined across clinics and produced only above thresholds that prevent identification of any patient or clinic. We act as controller for these statistics and may share them with third parties, including skincare brands and distributors, and may charge for them. No identifiable patient or clinic data is shared under this clause, and nothing in it changes our obligations as your processor.

Acceptable use

Do not use the service to send unsolicited marketing, to store information about people who are not your patients, or in any way that breaks UK law or your professional standards.

You are responsible for any links or images you add to a plan, including having the right to use them and complying with any brand, distributor or affiliate programme terms and any duty to disclose a financial interest to your patient.

Your content and ours

You own everything you enter into the service: your patients' information, your library, your plans and your advice. You give us the licence we need to store, process and display it to run the service for you. We own the service itself, including its design, software and the content we supply, such as pre-loaded product catalogues.

With your permission we may display your clinic's name and logo as a FacePlan clinic. You can withdraw that permission at any time by writing to hello@faceplan.co.uk.

Availability

We aim to keep the service available at all times, and we plan maintenance so that it causes no downtime where we can. We may change or improve features; we will tell you before removing one you rely on.

Liability

Changes and law

We will give you 30 days' notice of any material change to these terms. A change to our standard prices does not affect founding clinics, as set out above. These terms are governed by the law of England and Wales, and its courts have jurisdiction.
